Understanding outbound anti-deferral rules
U.S. taxpayers investing through foreign corporations often face different timing and character rules than they would when investing through domestic corporations. This course introduces the core anti-deferral regimes that can accelerate U.S. taxation when foreign corporate income is not currently distributed.
U.S. international tax regimes in practice
Learners examine when a foreign corporation is a controlled foreign corporation (CFC), how U.S. shareholder status is determined, and how anti-deferral regimes, such as Subpart F and net CFC tested income (NCTI), can create current U.S. income inclusions. The course explains key categories of Subpart F income and highlights common exclusions and computational considerations.
PFIC identification and elections
Learners also explore the basics of passive foreign investment companies (PFICs), including the following:
- Income and asset tests
- Excess distribution treatment
- Qualified electing fund (QEF) elections
- Mark-to-market elections
- Overlapping regime concerns
By the end of the course, learners will have a practical framework for identifying the major outbound anti-deferral regimes and recognizing how they affect U.S. taxpayers that hold interests in foreign corporations.
Note: This course is an except from International Taxation, part of Tax Staff Essentials Level 4.
